These Terms and Conditions, together with any published information on the Powerfleet website will govern the agreement between MiX Telematics Australasia (Pty) Ltd, a subsidiary of Powerfleet Inc (“PowerFleet”) and the referring party executing this Agreement ( “You”). You represent and warrant that: (i) you have full legal authority to enter into this Agreement; (ii) You have read and understand the Agreement, and (iii) You agree to the terms of this Agreement. If you do not have legal authority to enter into this Agreement or do not agree to these terms, please do not click accept.

By accepting these terms and conditions, You agree to the following terms and conditions read together the FAQ:

Unlimited Referrals: You can submit as many customer leads as you like, including new leads within different divisions of your company or parent company.

Consent Requirement: Before submitting any of the new customers details, You must obtain the customer’s prior consent, ensuring they are informed of:

The collection and processing of their data.
The nature of the data collected and its intended use.
Powerfleet's role as the data processor.
Any other parties who may access the data.
Their rights to access and correct their data by contacting Powerfleet.

Reward: A prepaid digital gift card or e-voucher to the value of up to AUD250 will be issued for each lead that is qualified by Powerfleet and that adheres to the Powerfleet ICP (ideal customer profile) guidelines and reaches the discovery stage of the sales process. Only one reward will be paid per business opportunity, regardless of the number of leads provided for that opportunity. The reward will be issued within 60 days of the lead being qualified.

Process: Referrals must be submitted using the 'Submit Referral' form, and You must have the referred customers’ permission and specific consent to share their personal information.

No Legal Relationship: Submitting a referral does not create a legal relationship (such as principal-agent, partnership, or joint venture) between You and Powerfleet. You are not authorised to act on behalf of Powerfleet or represent that You can, unless you receive written authorisation.

Legal Compliance: You agree to comply with all applicable laws, including but not limited to:

Anti-Bribery laws (e.g., Bribery Act, U.S. Foreign Corrupt Practices Act)
Export control laws and regulations.
Privacy and data protection laws.

Sanctions Compliance: You agree to comply with all U.S., UK, EU, AUS and other relevant sanctions and export control laws. You will not engage in any business dealings with embargoed countries or sanctioned individuals/entities.

Data Privacy: You agree to handle all personal data in compliance with applicable data protection laws.

Right to Reject/Disqualify or Cancel: PowerFleet reserves the right to reject or cancel any referral lead if there is suspected misuse, including:

Non-compliance with legal or regulatory requirements.
Submitting non-genuine leads or accounts.
Referring existing PowerFleet customers.

Territorial and Promotional Rights: PowerFleet grants You a non-exclusive, non-transferable, and non-sublicensable right to promote its Equipment and Services within Australia. You are prohibited from making representations or warranties on behalf of Powerfleet or committing Powerfleet to any obligations. You must also adhere to all applicable laws and refrain from making any false or misleading claims about Powerfleet or its Equipment and Services.

Privacy Policy: All data submitted will be processed in line with our Privacy Policy, which you are encouraged to review.
